Junking a car without a title in Virginia

Lost the title? Here's what Virginia law allows for older cars, and what to do if yours is newer.

The short answer

In Virginia, the title is the normal way to sell or scrap a car. For older cars there's an exception: a licensed auto recycler can demolish a vehicle that's at least 10 years older than the current model year without a title, once the DMV has checked it.

The 10-year rule

Under Virginia Code section 46.2-1608.2:

  • The car's model year has to be at least 10 years older than the current model year.
  • The recycler sends the DMV the VIN, year, make and model, with the state fees plus a $10 transaction fee.
  • The DMV checks a national crime database and a national title database for the owner and any lienholder.
  • The recycler can't demolish or dismantle the car until the DMV reports back. Expect a short wait before the deal is final.

Newer cars don't qualify; for them, the recycler needs the title or a salvage or nonrepairable certificate.

If your car is newer

Get a replacement title from the Virginia DMV before you sell. With the title in hand, you can sell to any licensed salvage dealer, demolisher or private buyer.

Watch out for

  • Anyone offering to scrap a newer car with no title. The law doesn't allow it, and a car that turns out to be stolen or financed can come back on you.
  • Cash deals that skip the DMV check. A licensed recycler has to wait for the DMV's results first.
